INSOLVENCY, BANKRUPTCY, AND RECONSTRUCTION
For many years, LIND has worked on cases for employees and their organizations, including in connection with corporate bankruptcies or delayed or non-payment of wages.
LIND’s responsible partner for the insolvency department has been appointed as a permanent liquidator to the Maritime and Commercial Court’s Bankruptcy Division.
Both Anders Bendtsen and Rasmus Riisbro are also members of the Danish Debt Collection Agency’s panel of lawyers in bankruptcy cases and are regularly used by the Danish Debt Collection Agency.
This experience has given us a strong foundation in insolvency, bankruptcy, and reconstruction. Today, we advise a wide range of clients, including companies in crisis, employees of insolvent companies, banks, and suppliers.
LIND currently has over 200 bankruptcy estates and compulsory liquidations under insolvency proceedings, including estates of considerable complexity and within almost all industries.
We can offer both the personnel and the expertise needed during the often very hectic phases when a company encounters financial difficulties. We know that this requires insight into other areas of law, including company law, labor law, and financing law. For us, it is always about ensuring the best possible outcome for the company and its creditors and limiting job losses.
Our clear goal is to handle bankruptcy estates quickly and with the greatest possible return for creditors and mortgagees – without compromising on quality. It is important that the liquidation of the company is carried out correctly and efficiently – and with the least possible loss for all involved.
During the bankruptcy proceedings, we pay particular attention to the possibilities of bankruptcy quarantine for the management – if the conditions are met.
We provide assistance and advice in connection with, among other things:
- Filing for bankruptcy and petitioning for reconstruction
- Acting as a creditor-appointed trustee and reconstruction administrator
- Handling both small and large bankruptcy estates and reconstruction
- Representing employee and creditor interests in general
- Securing and delivering special rights and assets
- Legal proceedings against bankruptcy estates, including avoidance proceedings brought by bankruptcy estates
- Establishing debt arrangements, including composition agreements, and assisting in negotiations with creditors
